Conflicto de competencia entre el Tribunal Superior de Cali, Sala Penal y el Tribunal Superior de Mocoa, Sala Única.
Luego de concluir que la autoridad judicial de la ciudad de Mocoa es la competente para conocer de la petición del accionante, la Corte decide remitir el expediente a dicho Tribunal para que sin más dilaciones imparta el trámite de primera instancia y profiera la decisión de fondo que corresponda.

- PRIMERO. DEJAR SIN EFECTOS el auto del 22 de julio de 2016 por medio del cual el Tribunal Superior del Distrito Judicial de Mocoa -Sala Única, se abstuvo de conocer la acción de tutela promovida por el ciudadano Orlando Esteban Arciniégas Murillas en contra del Ejército Nacional de Colombia -Ministerio de Defensa.
- SEGUNDO. Por Secretaría General de esta Corporación, REMÍTASE al Tribunal Superior el Distrito Judicial de Mocoa -Sala Única, la acción de tutela contenida en el expediente ICC 2987, a fin de que, sin más dilaciones, imparta el trámite de primera instancia y profiera decisión de fondo respecto del amparo solicitado.
- TERCERO. Por Secretaría General, COMUNÍQUESE la decisión adoptada en esta providencia a las partes y al Tribunal Superior de Cali-Sala Penal.
